Federal prosecutors involved in the Hunter Biden criminal case indicated on Friday that a plea deal is unlikely to occur and the case will most likely be headed for trial.

In June, the DOJ announced a plea agreement for President Joe Biden’s son over charges related to his filing of federal income taxes and his felony gun charge. However, a federal judge in Delaware said she would not accept the plea deal under the current conditions.

Judge Maryellen Noreika requested that a new deal should be drafted that does not offer a broad immunity for other charges that are related to Hunter’s business dealings. Biden then pleaded not guilty to two misdemeanor offenses for tax charges.

The judge in the case ordered Hunter’s lawyers to respond to the Justice Department’s “motion to vacate his plea schedule by Monday at noon,” according to Politico court reporter Kyle Cheney.

“During the July 26, 2023, hearing that the Court set on this matter, the Defendant pled not guilty,” prosecutors for U.S. attorney, now special counsel, David Weiss said in a filing. “Since that time, the parties have engaged in further plea negotiations but are at an impasse. The government now believes that the case will not resolve short of a trial.”

The DOJ also asserted in the motion that the location for the tax offenses lies in the Central District of California or in the District of Columbia, not Delaware.

The news comes as United States Attorney General Merrick Garland announced Friday that Weiss, who was appointed by former President Donald Trump, was appointed special counsel in the Hunter Biden probe.

Representative Lauren Boebert (R-Colo.) responded to the move claiming that she is “not extremely excited that anything will actually come of this” after blasting Weiss for trying to give Hunter a “sweetheart deal.”

The younger Biden and his father have notably become the central focus of congressional investigators as they are planning to subpoena the president and his family for their involvement with Hunter’s foreign business dealings while Joe was serving as vice president for the Obama administration.
